Terms of Use
Plain English summary — Use the app to track your training. Don't misuse it. Your data is yours. We're not liable if you injure yourself rolling. That's it, mostly.
1. Acceptance of Terms
By downloading, installing, or using Fight Cafe ("the App"), you agree to these Terms of Use. If you do not agree, please do not use the App. These terms form a binding agreement between you and the App's developer ("we", "us", "our").
2. Eligibility
You must be at least 13 years old to use Fight Cafe. By using the App you represent that you meet this requirement. If you are between 13 and 18, a parent or guardian must agree to these terms on your behalf.
3. License
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on any Apple device you own or control, for personal, non-commercial purposes, subject to these terms and the Apple Standard EULA.
4. Your Content
All training sessions, journal entries, and data you create in the App remain yours. By syncing data to our cloud you grant us a limited license to store and process it solely to provide the App's features to you. We do not claim ownership of your content.
5. Acceptable Use
You agree not to:
- Reverse-engineer, decompile, or disassemble any part of the App
- Attempt to access other users' data
- Use the App to upload illegal, harmful, or abusive content
- Automate or scrape the App's backend services
- Resell or sublicense the App
6. Health and Safety Disclaimer
Fight Cafe is a data-tracking tool, not a medical or fitness prescription service. Nothing in the App constitutes medical advice. Brazilian Jiu-Jitsu is a contact sport that carries inherent risk of injury. You assume all risk associated with your training. Always train under qualified supervision and consult a healthcare professional before beginning or intensifying a training program.
We are not liable for any injury, illness, or harm resulting from activities tracked or suggested by the App.
7. Third-Party Gyms and Waivers
The App may display information about third-party gyms, open mat schedules, and links to waiver forms. We do not operate these gyms, guarantee the accuracy of their listings, or accept liability for experiences at those facilities. Waiver links are provided as a convenience only — you are responsible for reading and understanding any waiver before signing.
8. Third-Party Links
The App includes optional links to Google Maps (for gym ratings) and calendar apps (for session scheduling). These are external services governed by their own terms. We are not responsible for third-party services.
9. Intellectual Property
The Fight Cafe name, logo, design system, and App code are owned by us and protected by copyright and other intellectual property laws. You may not use our branding without written permission.
10. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted or error-free operation.
11. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including loss of data or training records. Our total liability for any claim shall not exceed the amount you paid for the App in the 12 months prior to the claim (which, if the App is free, is $0).
12. Indemnification
You agree to indemnify and hold harmless the App's developer from any claims, damages, or expenses arising from your violation of these Terms or misuse of the App.
13. Termination
We may suspend or terminate your account if you violate these Terms. You may terminate your account at any time from Profile → Account → Delete Account. Sections 4, 9, 10, 11, and 12 survive termination.
14. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Travis County, Texas.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be surfaced via an in-app notification at least 7 days before they take effect. Continued use of the App after that date constitutes acceptance of the updated Terms.
